How Can the State Stimulate the Development of Mediation in Ukraine?

The Ministry of Justice of Ukraine, in particular the Directorate of Justice and Criminal Justice, has carried out an in-depth study on ways to encourage parties to choose mediation instead of court proceedings.

The analysis focused on:

  • the regulatory framework and its gaps;
  • judicial practice and ECHR decisions;
  • the position of the professional community and findings of academic research;
  • statistics and international experience.

As a result, a set of specific recommendations has been developed and published on the official website of the Ministry of Justice of Ukraine.

Why does this matter?

Mediation means preserving relationships, fostering dialogue, and ensuring dignified dispute resolution. The more actively the state promotes the use of mediation, the stronger its impact will be on developing a culture of communication and raising awareness of the value of mutual understanding in society.
