Mediation and Sport: A Space for Fair Play and Dialogue

On April 26, the world celebrates World Intellectual Property Day. The theme for 2026, selected by the World Intellectual Property Organization (WIPO), is “Intellectual Property and Sport: Feel the Beat of IP”, highlighting how intellectual property supports the development of sport — from innovative equipment and digital technologies to sports brands, broadcasting rights, and major sporting events.

At the same time, sport is a field where conflicts and disputes frequently arise. Athletes, clubs, coaches, federations, sponsors, and event organizers may all become parties to disagreements. This is why mediation is increasingly being used as an effective method for resolving disputes within the sports sector.

Unlike court proceedings, mediation enables parties to preserve professional relationships, protect reputations, and maintain opportunities for future cooperation. This is particularly important in sport, where parties often continue to interact long after a conflict has been resolved.

Mediation can be useful in disputes involving:

• contractual relationships between athletes and sports clubs;
• the use of brands, trademarks, and broadcasting rights;
• sponsorship agreements;
• internal conflicts within teams, federations, and sports organizations.

The effectiveness of this approach is also recognized internationally. Specialized mediation procedures are available for disputes involving sport and intellectual property, including those administered by the WIPO Arbitration and Mediation Center. In addition, the Court of Arbitration for Sport (CAS) recognizes mediation as one of the alternative dispute resolution mechanisms available alongside arbitration.

Sporting success is impossible without teamwork, mutual respect, and effective communication. For this reason, mediation is becoming an important tool for promoting fair play not only on the field of competition but also in the relationships between all participants within the sports ecosystem.
