Mediation Legal Insights: Expert Analysis of Legislative Initiatives in Mediation

The Ukrainian Academy of Mediation is launching a new series of publications, Mediation Legal Insights — expert opinions and commentaries on legislative initiatives and regulatory frameworks in the field of mediation and other alternative dispute resolution (ADR) mechanisms in Ukraine.

Experts and UAM representatives are actively engaged in improving the legal regulation of mediation, participating in the development and review of legislative proposals. That is why we are starting this series of publications to share professional insights on draft laws and legal acts that directly influence the practice of mediation and ADR.

First analysis: Draft Law No. 12448 (January 27, 2025)

We begin with an analysis of Draft Law No. 12448, which proposes amendments to Article 6 of the Law of Ukraine “On Mediation” — Confidentiality.

Luiza Romanadze, President of the Ukrainian Academy of Mediation, commented:

“The proposed amendments to the Law of Ukraine ‘On Mediation’ are unnecessary. The current version of Article 6 already provides for the possibility of disclosing confidential information in cases established by law. Such exceptions should be determined in special laws, particularly those concerning mechanisms for preventing and combating domestic violence and gender-based violence.”
